Online Course: How to Apply the Provisions of the Proportionality Test Directive

The European Commission recently launched the online course “Making regulation of services ‘single market proof’ – how to apply the rules of the Proportionality Test Directive”, now available on the EU Academy platform.

The course provides detailed explanations and guidance for applying the provisions of Directive (EU) 2018/958 regarding a proportionality test. Participants will familiarize themselves with the principles and requirements of the Directive-an essential tool for assessing the impact of national regulations on access to, and the practice of, professions within the Internal Market. In other words, the course serves as a valuable resource for understanding how proportionality assessments are applied during the drafting of national regulations.

The course is designed for public officials and regulatory experts within national competent authorities, all stakeholders involved in the application of European legislation in this field.

Participants will be able to develop and strengthen their skills regarding:

  • Understanding the purpose of proportionality assessments as set out in the Proportionality Test Directive.
  • Identifying the roles and responsibilities of the authorities involved in this process.
  • Applying fundamental principles of proportionality, as well as the substantive and procedural obligations required by the Directive.
  • Utilizing the criteria necessary for conducting a proportionality analysis.
  • Appreciating the importance of the proportionality test as a preventive mechanism to avoid the adoption of disproportionate regulations.
