Electronic signature
In accordance with the provisions of Law no. 455/2001 on the electronic signature, with subsequent amendments and additions,
“Art. 5. – The entry in electronic form, to which an extended electronic signature has been incorporated, attached or logically associated, based on a qualified certificate not suspended or revoked at the time and generated using a secure electronic signature creation device, is assimilated , as regards its conditions and effects, with the document under private signature;
Art. 6. – The written document in electronic form, to which an electronic signature has been incorporated, attached or logically associated, recognized by the one to whom it is opposed, has the same effect as the authentic act between those who subscribed it and those that represent their rights”;
Art. 7. – In cases where, according to the law, the written form is required as a condition of proof or validity of a legal act, a document in electronic form meets this requirement if it has been incorporated, attached or logically associated with it extended electronic signature based on a qualified certificate and generated by means of a secure signature creation device’.
Also, in accordance with the provisions of the Emergency Ordinance no. 38/2020 regarding the use of documents in electronic form at the level of public authorities and institutions,
“Article 3
(1) Documents issued in electronic format by public authorities and institutions will be signed with a qualified electronic signature;
(2) The acts provided for in para. (1) are assimilated to authentic documents”.
The National Center for the Recognition and Equivalence of Diplomas uses the qualified certification services offered by the Special Telecommunications Service, in accordance with Art. 31 of Law no. 455/2001 on the electronic signature, with subsequent amendments and additions.
Checking the validity of the electronic signature
In order to verify the validity of an electronic signature applied to a PDF file, the file must be downloaded in the computer and the file must be opened with the Adobe Acrobat Reader program. In this situation, the result obtained is:
In the case of signatures applied with the new software version of the application made available by the Special Telecommunications Service, the green tick has been removed, the authenticity of the electronic signature being confirmed by the message “Signed, with all signatures valid”/”Signed and all documents are valid” displayed by Adobe Acrobat Reader.
Electronic signature display errors
If the file is opened with a browser, the validity of the electronic signature cannot be verified, and a yellow question mark will be displayed on the screen:
In the case of signatures applied with the new software version of the application made available by the Special Telecommunications Service, the yellow question mark is no longer displayed.
